Basic Facts

The defendant is the central bank of the Republic of Korea with the aim of contributing to the sound development of national economy by seeking price stabilization through the establishment and execution of efficient monetary and credit policies, and the plaintiffs are the workers who are or were the workers of the defendant.

Article 42 of the collective agreement and the Regulations on the Implementation of the Rules of Remuneration, the Rules of Employment 206, and the Rules of Employment 2006 and the collective agreement between the defendant and the defendant trade union in 2011 provide that separate supplementary agreements on wages shall be concluded, and Article 45(1) provides that with respect to contractual work hours, “eight hours per day and forty hours per week” shall be deemed working hours. The terms used in this provision of Article 2 (Definitions), of the Remuneration Regulations (the 28th Franzon Resolution, January 1, 2010), are as follows:

1. “Remuneration” means the members, executive members, and the audit and inspection of executive members, and the basic salary and allowances for the staff;

2. The term “basic pay” means a “principal pay” and a “grade pay according to a position or class” paid by year or class;

3. The term "retirement allowances" means, in cases of domestic employees, the work allowances, family allowances and overtime work allowances, and, in cases of overseas employees, the adjustment allowances;

Article 9 (Overtime Work Allowances) (1) In relation to banking services, overtime work (including overtime work, night work and holiday work prescribed by the Labor Standards Act)
