A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

From January 6, 2014 to January 22, 2014, the Defendant: (a) was hospitalized at the Dental Medical Hospital located in G in G in G, and received medical treatment for 17 days, such as the catum’s salt, tension, etc.; and (b) on January 22, 2014, the Defendant filed a claim for insurance proceeds with the victim E company, along with a written confirmation of hospitalization.

However, in fact, B did not have the necessity of hospitalization at the time, and in fact did not receive hospitalization at the hospital.

Nevertheless, on January 23, 2014, the Defendant, by deceiving a person in charge of the payment of insurance proceeds of the victim E corporation, received KRW 2,225,140 from the victim E corporation to the Defendant’s F bank account on January 23, 2014, including the remittance of KRW 2,225,140 from the Defendant’s F Bank account, from that time to February 24, 2017, filed a claim for insurance proceeds on the grounds of hospitalization in B in the same way as shown in attached Table 1, and received a transfer of KRW 84,87,264 in total as insurance proceeds from the damaged insurance company, and received KRW 84,87,264 in total under the pretext of insurance proceeds from the damaged insurance company from January 19, 2015 to January 23, 2017.

Accordingly, the Defendant was given a total of KRW 135,630,481 by deceiving the damaged insurance companies.
