All of the plaintiffs' claims are dismissed.

All the costs of lawsuit are assessed against the plaintiffs.

1. Details of the disposition;

A. Based on the Industrial Technology Innovation Promotion Act and the Enforcement Decree thereof, the Defendant is the head of the Korea Evaluation Institute of Industrial Technology (hereinafter “Evaluation Institute”) entrusted by the Minister of Trade, Industry and Energy with the duties concerning restrictions on participation in national research and development projects and the duties concerning the full or partial recovery of the subsidized project costs.

B. The Plaintiff-B University Industry-Academic Cooperation (hereinafter “Plaintiff-Academic Cooperation Union”) is a corporation established to administer the business affairs of the Plaintiff-B University’s industry-academic cooperation, and is a major institution that performed the “C” task (hereinafter “instant task”). The Plaintiff-A is a general manager who performs and manages the instant task, who is a semiconductor system engineering and professor of the Plaintiff-B University’s semiconductor system.

Plaintiff

An industry-academic cooperation shall enter into an agreement on the industrial technology innovation project (total development period: 48 months from October 1, 2016 to September 30, 2020) with the Evaluation Institute, which is an institution in exclusive charge of the instant task, and receive the Government contributions from the Defendant.

The final business objective of the instant task is the final business objective according to the business plan submitted by the Plaintiffs after modifying and submitting the project plan in the 3rd-year Convention.
