A defendant shall be punished by imprisonment for not less than three years and six months.

Punishment of the crime

On April 2, 2010, the Defendant was sentenced to four months of imprisonment for fraud at the Sungnam Branch of Suwon District Court on April 2, 2010, and completed the execution of the sentence on June 23, 2010.

The Defendant from around 2007 to around 140 million won in financial rights with bad credit standing and did not have any intention or ability to repay money from the victim E (the age of 62) even if he borrowed money from the victim E (the age of 62) or uses the credit card of the victim.

On August 10, 2010, the Defendant made a false statement to the victim E, “Any difficulty in preparing a new business entity. The amount to be settled in F, a business entity previously operated, would have KRW 100 million, to lend money.”

However, in fact, the defendant did not have any claim against F, and even if he borrowed money from the victim, he did not have any intention or ability to repay it.

As can be seen, the Defendant received 1.1 million won in total from the time on August 25, 201, including the fact that the Defendant belonged to the said victim and received 1.1 million won as the borrowed money from the victim, from that time, until August 25, 2011, the Defendant received KRW 138,650,000 in total, 27 times as indicated in the [Attachment Table 1-27]

In addition, on August 8, 2010, the Defendant issued three credit cards from August 8, 2010 to February 22, 2011, as indicated in the [Attachment Table] No. 26,910,820 won (new non-paid card price 12,321,040 won, card price 6,931, 100 won, 768, 6758, 670 won) to the above victim, on the ground that the Defendant did not acquire the above three credit cards from August 8, 201 to February 22, 201, while using the said three credit cards as indicated in the [Attachment Table] No. 26,910,820 won (the new non-paid card price 12,321,040 won).
