A defendant shall be punished by imprisonment for one year.

The defendant shall obtain money 242,00 won by fraud from C who is an applicant for compensation, and D who is an applicant for compensation.

Punishment of the crime

『2013고단825』 피고인은 2012. 2. 15.경 수원시 일대에 있는 상호를 알 수 없는 PC방에서, 인터넷 네이버 중고나라 사이트에 아이팟터치를 판매한다는 글을 게시한 후 이를 보고 연락을 한 피해자 E에게 “153,000원을 먼저 보내주면 아이팟 터치를 보내주겠다”라는 취지로 거짓말을 하였다.

However, the defendant did not have any intent or ability to deliver the above goods even if he receives money from the victim because he did not have the above goods.

As such, the Defendant, by deceiving the victim as such, was transferred KRW 153,00 from the victim as the purchase price on February 15, 2012, to the single bank account in the name of the Defendant.

In addition, from February 15, 2012 to February 17, 2013, the Defendant received KRW 1,298,000, in total, 11 times from 11 victims under the aforementioned method, as shown in attached Table 1 of Crimes List 1.

Around March 7, 2012, the Defendant made a false statement to the effect that “The Defendant would send 110,000 won first to the victim G who sent 110,000 won, and then will send 2 copies of the gift certificates for the Posp Posp Posp posp posp posp posp posp posp posp posp posp posp posp posp posp posp posp posp posp posp posp posp pos

However, the defendant did not have the above merchandise coupon and did not have an intention or ability to send the merchandise coupon even if he received money from the victim.

As such, the Defendant, by deceiving the victim, received KRW 110,00 from the victim as the purchase price on March 7, 2012, under the name of the Defendant, a transfer of KRW 110,00 from the bank account in the name of the Defendant.

In addition, from March 7, 2012 to February 7, 2013, the Defendant, as described in attached Table 2, together with this, KRW 682,00,00, totaling six times from six victims to six times in total, as stated in attached Table 2.
