Reasons
The reasoning for this part of this Court’s reasoning is as follows, and this part of this Court’s reasoning is consistent with the reasoning of the judgment of the first instance except for any dismissal or addition as follows. Thus, it is acceptable in accordance with the text of Article 420 of the Civil Procedure
(except that part is limited to co-defendants). The first instance judgment's "I" in the fourth paragraph (a) of the first instance judgment is changed to "Ground I".
The reasoning of the judgment of the court of first instance is that the management body is the 4th part of the reasoning of the judgment of the court of first instance."
The reasoning of the judgment of the first instance is as follows.
The following shall be added to the first clause of the first instance judgment of "the defendant does not pay a total of 593,900 won for management expenses from July 2015 to April 2016."
(f) On March 8, 2018, the head of Seo-gu Daejeon revoked the disposition to accept the report of the superstore manager on the Plaintiff, and thereafter, S filed a report with the head of Seo-gu Daejeon on April 17, 2019 after obtaining the consent and designation of at least 1/2 of the occupant occupants of the instant shopping mall. The head of Seo-gu Daejeon issued the written confirmation of the superstore manager to S on the same day after accepting the said report. The plaintiff asserts that as the superstore manager of the commercial building of this case, the plaintiff has the authority to collect management expenses from the defendant.
A superstore manager has the authority to impose and collect management expenses, which are expenses incurred in the maintenance and management of a superstore, against the merchants operating a superstore by leasing a superstore to the sectional owners of the superstore, and to impose and collect management expenses due to the lawful establishment of the superstore and the completion of reporting procedures (Supreme Court Decision 2014Da46570 Decided March 10, 2016). However, a superstore manager has the authority to impose and collect management expenses.
