Punishment of the crime

1. Around 00:35 on June 10, 2014, the Defendant was under the influence of alcohol by 0.124% on blood alcohol concentration, and on the roads front of the central market located in Sungdong-dong, racing, the Defendant driven a 1.5km-weight D class and one ton of freight vehicle at approximately 1.5km at the front of the small oil station located in the same location.

2. 공무집행방해 피고인은 같은 날 01:39경 경주시 E 소재 F파출소에서, 위와 같은 범행으로 현행범인 체포되어 조사를 받기 위해 대기하던 중 물을 마시기 위해 잠시 풀었던 한쪽 수갑을 위 파출소 소속 경찰관인 G 경위가 다시 채우려고 하자 욕설을 하면서 발로 위 G의 허벅지와 배를 5회 가량 걷어찼다.

또한 피고인은 같은 날 02:32경 같은 파출소 소속 경찰관인 H 경사를 향해 자신의 구두와 파출소 TV 리모콘을 차례로 집어던지고, 이를 제지하던 같은 파출소 소속 경찰관인 I 경사의 낭심을 손으로 잡아당기고 발로 배를 수회 걷어찼다.
