A defendant shall be punished by imprisonment for not less than one year and six months.

An applicant for compensation shall be dismissed.

Punishment of the crime

The defendant of the "2018 Highest 508" loans 10 million won to the victim E through D on November 7, 2017, the defendant will pay 200,000 won interest after he/she lends 10,000 won to the victim E.

“False speech” was made.

However, in fact, the Defendant had a debt of KRW 70 million at the time, and borrowed money under the pretext of giving an interest to many unspecified persons to repay the debt, and thereby preventing the so-called repayment of another person’s debt with the said money from repaying the debt. Thus, even if he borrowed money from the injured party, the Defendant did not have any intention or ability to repay the money normally.

The Defendant, as such, by deceiving the victim, received from the damaged party a transfer of KRW 10 million to the F Bank Account (G) in the name of the Defendant on the same day.

Accordingly, the defendant was given property by deceiving the victim.

The defendant of "2018 Highest 1553" around April 8, 2016, the defendant extended interest to the victim J within the I convenience store located in Ulsan-gu H, Ulsan-gu, Seoul-do.

However, the Defendant had a debt worth KRW 100 million at the time, and the Defendant’s words or descendants did not run the bond business, and the Defendant borrowed money under the pretext of giving interest to many unspecified persons to repay the said debt and prevented so-called repayment of another person’s debt with the said money from repaying the money. Thus, even if the Defendant borrowed money from the damaged person, there was no intention or ability to pay the money normally.

As such, the Defendant, by deceiving the victim, received KRW 20,000,000 from the victim as the borrowed money on April 8, 2016 from the victim, to the K account (L) in the name of the Defendant, and received a total of KRW 80,00,000 from around that time to November 7, 2017 as shown in the list of crimes in attached Table 1.

Accordingly, the defendant is the victim.
