A defendant shall be punished by imprisonment for six months.
However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The defendant is a person who has served as an insurance designer.
1. On April 30, 2013, the criminal defendant against the victim D told the victim D (the victim’s death around November 13, 2013) to the effect that “The victim would pay interest twice per month if he/she lends money.”
However, the defendant was liable to E, etc. for a debt of 260 million won or more, and even if he borrowed money from the damaged party, he did not have any intention or ability to repay the money.
Nevertheless, the Defendant, as if he/she had the intent or ability to pay the second installment interest each month to the victim, received a false statement from the victim to the IBK enterprise bank account in the name of the Defendant, and acquired the amount of KRW 49 million on April 30, 2013, and KRW 4750,000 on July 10, 2013 from the victim as the borrowed money.
2. Fraud against victim F;
A. On February 24, 2014, the Defendant tried to make an investment in a victim F apartment located in Seo-gu Incheon, Seo-gu, Incheon, with the victim F’s apartment.
To lend KRW 50 million to 50 million, interest shall be paid twice per month.

However, the Defendant did not intend to make an investment in the lending company, and was in need of money from others to prevent the repayment of debts borrowed from others, as stated in paragraph 1, and there was no intention or ability to repay the said money even if the Defendant borrowed money from the said victim.
Nevertheless, the Defendant, as if he/she had the intent or ability to pay the second installment interest each month to the victim, makes a false statement as above, and received from the victim the above IBK corporate bank account from the victim to the IBK corporate bank account on February 25, 2014 and acquired it by money as a loan.
B. On March 23, 2016, the Defendant, at the office of Jung-gu Incheon, Jung-gu, Incheon, the Defendant: (a) “Around March 23, 201, required money to engage in the speech business.”
