1. Determination on the cause of the claim

가. 원고의 주장 피고는 C, 스카이텍, 유신코리아, D, E, 톡톡코리아의 카탈로그, 팜플렛 등 홍보물 제작을 위한 디자인작업을 하여 그 결과물을 원고에게 인도하기로 약정하였다.

Therefore, the defendant is obligated to deliver to the plaintiff the personal design, the earth's shop, the cargo file for editing and correcting the above promotional materials, and the logs and photographs of the above companies provided by the plaintiff for production of promotional materials.

또한 원고가 피고에게 제공한 위 업체들의 로고, 상품사진 등 초안 자료비 1,800,000원, 톡톡코리아의 홍보물 중 미완성된 2건에 대한 초안 자료비 700,000원, 홍보물을 납품하지 못함으로 인해 발생한 위약금 700,000원 및 손실금 1,400,000원 합계 4,600,000원의 손해를 배상할 의무가 있다.

(b) Determination 1) Each description and image of Gap evidence Nos. 1, 2, 3, 1, 2, and 3 (including serial numbers), and the whole purport of the pleading may be acknowledged as follows.

(2) 원고는 C, 주식회사 스카텍, 주식회사 유신코리아, D, 강화분쇄기(E), 주식회사 톡톡코리아 등 업체들로부터 의뢰받은 카탈로그, 리플렛 등 홍보물의 제작을 위해 그 디자인 작업을 피고에게 의뢰하였다.

At this time, the Plaintiff provided the Defendant with advertising manuscripts, product photographs, logos, etc. necessary for the design work of promotional materials by the method of transmitting electromagnetic waves to the Defendant using Kakaox or Mem.
