피고인은 2012. 10. 9. 03:00경 제주시 C노래방에서, 평소 알고 지내는 피해자 D(여, 36세)과 노래를 부르면서 놀다가 피해자가 누군가로부터 전화를 받고 "일을 하러 가겠다"라고 말하므로 피고인이 피해자에게 "오늘은 술을 취했으니 일을 하지 말라"라고 말하면서 서로 말다툼을 하다가 피해자가 자신에게 "거지같이"라고 말하면서 손바닥으로 왼뺨을 1회 때리는데 불만을 품고, 왼손바닥으로 피해자의 오른뺨을 1회 때려 2주간의 치료가 필요한 얼굴부위 표재성 손상, 박리, 찰과상을 가하였다.
