1. 상해 피고인은 2014. 3. 4. 23:40경 김해시 B에 있는 C노래주점에서 종업원인 피해자 D(26세)으로부터 술값 계산을 요구받자 자신의 일행이 계산하기로 했음에도 자신에게 계산을 요구한다는 이유로 화가 나, 위 C노래주점 3번룸 앞 복도에서 “야 새끼야 봐라, 지가 계산을 한다고 안하나. 왜 가는 나를 잡고 지랄이고.”라고 하면서 왼손으로 피해자의 멱살을 잡고 오른 손바닥으로 피해자의 왼쪽 뺨을 2대 때리고, 피해자를 3번룸으로 끌고 들어가 그곳에 있던 테이블을 엎고 테이블 위에 있던 컵을 바닥에 던지고 오른 손바닥으로 피해자의 왼뺨을 5~6대 때리고, 피해자를 카운터로 끌고 가 지배인 E에게 “이 새끼 교육 똑바로 시켜라.”라고 하면서 냉장고 안에 있던 양주병을 꺼내들고 피해자를 때리려고 하였으나 E에게 위 양주병을 빼앗기자 “이 새끼 죽여 버린다.”라고 하면서 오른발로 피해자의 왼쪽 정강이를 찼다.

그 후 피고인은 피해자로부터 말로 해결하자는 이야기를 듣고 피해자와 함께 3번룸으로 들어갔으나 그곳에서 다시 오른손으로 피해자의 왼뺨을 3대 때렸다.
