A defendant shall be punished by imprisonment for not less than eight months.

The defendant shall order 40 hours to complete the sexual assault treatment program.

Punishment of the crime

1. Fraud;

A. On April 12, 2014, the Defendant committed a crime on April 12, 2014, around 03:36, the Defendant exempted the Defendant from the obligation to pay the taxi fee equivalent to that amount by presenting the 24,180 won taxi fee to the victim, who was lost on the same day, to the Defendant’s national bank credit card (credit card number: D) in the name of the Defendant on the ground that C was lost on the same day.

In this respect, the Defendant acquired pecuniary benefits by deceiving the victim.

B. The Defendant committed the crime of April 17, 2014, at the E shop located in Yangyang-si around 00:45, Apr. 17, 2014, the Defendant paid the price for the goods by presenting the credit card of the national bank in the name of the Defendant under the same circumstances as that of the Defendant, and was offered by the victim to the employees of the above store, who were the victim, as if the Defendant had completed the credit card of the national bank in the name of the Defendant under the same circumstances as that of the above paragraph. The Defendant was provided with liquor

Accordingly, the defendant was given property by deceiving the victim.

2. No person who violates the Specialized Credit Financial Business Act shall sell or use lost or stolen credit cards or debit cards;

A. On April 12, 2014, the Defendant paid 24,180 won of taxi fares using a credit card (credit card number: D) of a national bank (credit card number) lost by C, as described in paragraph 1(a).

B. On April 19, 2014, the Defendant settled KRW 17,300 for liquor and charge using a credit card (credit card number: D) of a national bank lost by C, as described in paragraph 1(b).

3. A quasi-indecent act by compulsion: (a) on April 20, 2014, the Defendant used the victim’s drinking alcohol with the mutual influence in Bupyeong-gu Incheon Bupyeong-gu, Incheon, with the victim C (here, 35 years of age) and other members of the foregoing gathering, and used the victim’s drinking alcohol and drinking alcohol in depth on the part of the victim.
