Punishment of the crime

The Defendant, as the representative of the D Hospital located in Gwangju North-gu C, is an employer who ordinarily employs 70 workers and operates a health business.

1. When a worker dies or retires, the employer in violation of the Labor Standards Act shall pay the worker wages, compensations, and other money or valuables within 14 days after the cause for such payment occurred;

Nevertheless, from December 3, 2013 to July 13, 2014, the Defendant served in the foregoing hospital and did not pay KRW 666,660 on July 2014 to E’s retirement from office within 14 days from the date of retirement.

1. As set out in the list of crimes Nos. 1 to 5, 7, 9, and 10, the amount of eight workers who were employed in the above hospital and were retired and paid 24,609,650 won in total and annual paid leave allowance not paid within 14 days from the date of retirement.

2. An employer who violates the Guarantee of Workers' Retirement Benefits Act shall, in case where a worker retires, pay the retirement allowance within fourteen days after the cause for such payment occurred; and

Nevertheless, from February 1, 2013 to July 12, 2014, the Defendant was serving in the foregoing hospital and did not pay KRW 2,358,424 of the F's retirement pay that was retired within 14 days from the date of retirement.

1. A list of crimes Nos. 2, 4, 9, 11 through 15, 17, 18, 20 through 22, 25, 26, 29, 30, 37, and 112,387,124 of the retirement allowances of 19 workers employed in the above hospital and employed in the above hospital were not paid within 14 days from the date of retirement.

The Defendant is the representative of the D Hospital in Gwangju North-gu, who ordinarily employs 70 workers and operates a health business.

1. When a worker dies or retires, the employer in violation of the Labor Standards Act shall pay the wages, compensations, and other money or valuables within fourteen days after the cause for such payment occurred;

Nevertheless, the Defendant served in the above hospital from September 1, 201 to September 30, 2014 and retired from office.
