Punishment of the crime

The Defendant is the E representative in Gangnam-gu Seoul Metropolitan Government D and the fourth floor, who runs a health business with eight regular workers.

When a worker dies or retires, the employer shall pay the wages, compensations, and other money and valuables within fourteen days after the cause for such payment occurred.

Provided, That the date may be extended by mutual agreement between the parties in extenuating circumstances.

Nevertheless, the Defendant, at the above workplace from February 10, 2019 to October 31, 2019, did not pay KRW 2,600,000 of the retired workers F as wages in October 2019, the extension allowances of KRW 260,000, the extension allowances of KRW 389,750, and the food substitute 389,750 within 14 days from the date of retirement without an agreement on the extension of the payment period between the parties.

Nevertheless, the Defendant, at the above workplace from November 1, 2017 to May 31, 2019 and retired from office, did not pay KRW 3,062,206 in total, and KRW 1,180,267 in the above G retirement pay of KRW 3,722,973 in total, and KRW 3,722,973 in the annexed crime list Nos. 1 and 2 within 14 days from the date of each retirement without agreement on the extension of the due date between the parties, as well as KRW 3,062,206 in total, and KRW 1,80,267 in the annexed crime list.
