Defendant shall be punished by a fine of one million won.
If the defendant fails to pay the above fine, 50,000 won shall be one day.
Reasons
Punishment of the crime
The Defendant, as a person who was the representative of the village residents of the Korea Electric Power Corporation, was the representative of the Korea Electric Power Corporation, prepared a annual list with the signatures and seals of residents of E, F, and C3 village located in D in order to oppose the passage of the said D community, which was planned by the Korea Electric Power Management Agency (hereinafter referred to as the “Korea Electric Power Corporation”). At the time, the Defendant, as for E and F village residents, explained that he was the representative of the village residents of the Korea Electric Power Corporation, he was a signature and seal of the residents of the E, F, and C, and drafted the above annual list (hereinafter referred to as “the opposing list”).
However, at the later time, the agreement to the effect that it would not raise any objection to the construction of a steel tower and pay compensation for the said steel tower (hereinafter “instant agreement”) and the Defendant, etc. were appointed as the representative in relation to the said steel tower construction project (hereinafter “instant project”), and upon the request for the preparation of the “Annual List for the Appointment of Resident Representatives in the name of the residents of the D Village,” the purpose of “B” was to receive the compensation for the said EF village residents following the death of the residents of the said EF village, for the purpose of paying the compensation for the village of the said EF village.
1. On December 24, 2008, the Defendant forged private documents at the I restaurant located in H of the Republic of Korea on December 24, 2008. To oppose the instant project, the Defendant: (a) completed a total of 28 members in the attached list of crimes, including J, and appointed the Defendant, etc. as a representative of the said village; and (b) attached the instant list as if the Defendant, etc. consented to the construction of a steel tower and the payment of compensation.
Accordingly, for the purpose of uttering, the Defendant forged the “instant annual list,” which is a private document on rights and obligations.
2. The defendant may be aware of the forgery in his or her place.
