1. The Defendant’s KRW 145,00,000 for the Plaintiff and 6% per annum from December 16, 2016 to May 14, 2020.
Reasons
1. Basic facts
A. On September 17, 2013, the Plaintiff entered into a lease contract between the Plaintiff and the Defendant. (2) On November 2, 2015, the Plaintiff: (a) leased the first, second, and third floor of the instant building from D, E, KRW 200,00,000, KRW 14,000 per month of rent (payment on the last day of each month); (b) from October 31, 2013 to October 30, 2015, with the term of lease fixed; (c) operated a fish farming institute for young children with the trade name “F” in the instant building; (d) extended the above lease agreement on November 2, 2015, the Plaintiff set the entire lease deposit from D, E, KRW 20,00, KRW 20,000, KRW 20,000 per month of rent (payment on the last day of each month); and (d) from October 31, 2015 to October 31, 2015.
3) D and E established a company that is engaged in real estate rental business, etc. on February 7, 2017 by investing in kind the instant building in kind (E is the representative director of the Defendant, and D was appointed as the Defendant’s internal director, respectively.
(4) On February 14, 2017, the Plaintiff concluded a lease agreement with the Defendant for the lease deposit of KRW 200,000,000, monthly rent of KRW 20,000 (value-added tax separate, and payment after the last day of each month) and from January 1, 2017 to December 31, 2018, as the ownership transfer registration for the instant building was completed on the grounds of investment in kind on January 1, 2017.
(hereinafter “instant lease agreement.” According to the instant lease agreement, the Defendant may terminate the contract in a case where the annual amount of the Plaintiff’s rent reaches three (3) rents.
B. The structure of the warehouse of the first floor of the instant building and the occurrence of a fire are installed outside the first floor of the instant building.
