1. Defendant A Housing Reconstruction Project Establishment Promotion Committee: KRW 640,069,586 to the Plaintiff and its 302,000 among the members.
Reasons
1. Basic facts
A. The Plaintiff is a company whose business purpose is urban environment rearrangement project management business, etc., and Defendant A-Housing Reconstruction and Improvement Project Establishment Promotion Committee (hereinafter “Defendant Promotion Committee”) is the association establishment promotion committee organized pursuant to the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents (hereinafter “Urban Improvement Act”), which consists of one project district (hereinafter “instant project district”). The rest of the Defendants are the promotion committee members of Defendant Promotion Committee.
B. On October 30, 2010, the Plaintiff entered into a contract for the specialized management of housing reconstruction improvement project (hereinafter “instant service contract”) with the Defendant Promotion Committee to perform the duties of the said promotion committee’s reconstruction improvement project, and the main contents are as follows.
(B) Article 4 only stipulates that the defendant's promotion committee shall be "for promotion" (Scope of maintenance business services)
1. The Plaintiff shall directly perform the following services in relation to this contract, or advise and support the performance of the services to be performed, and the preparation and processing of the documents related to the services of the said rearrangement project shall be governed by the relevant Acts and subordinate statutes, such as the Enforcement Ordinance of the Urban Improvement Act and the Enforcement Ordinance of the Promotion Committee
(a) Support for and consultation on application for safety inspection and designation of an improvement zone;
(b) Affairs and advice for applying for authorization for the establishment of the association;
(c) Provision of strict support and advice to apply for authorization for implementation of projects;
(d) Affairs related to applying for approval of a management and disposal plan and consultation (hereinafter referred to as "loan and repayment") Article 6;
1. The Plaintiff shall lend the operating expenses (including office fixtures and fixtures) for the progress of business due to economic circumstances.
2. In the event that the Promotion Council requires the project cost other than that set forth in paragraph 1, the Promotion Council shall decide upon the Plaintiff’s request for a loan in consultation with the Plaintiff.
3. The executor and the plaintiff enter into a monetary loan agreement.
