Punishment of the crime

1. Defendant A is the representative director of Company B, who takes overall charge of, and manages the safety and health affairs of workers belonging to the site of the Gyeonggi-gu Development Project site.

A business owner shall take measures necessary for the prevention of hazards caused by machinery, apparatus, and other equipment when running his/her business.

In this regard, as a specific safety measure, the business owner should install a motor, electric percussion, fishing, swimming, fluor, wheel chairs, bell, and personal bridge, etc. on the parts where the workers are likely to face danger.

Nevertheless, at around 14:00 on September 30, 2014, the Defendant did not install protective protection facilities such as covers on the power transmission line consisting of the compact presses, grass, bell, etc. used in D-4 neighboring the construction site.

(b) A business owner shall take measures necessary to prevent any danger caused by electricity, heat or other energy in operating his/her business;

In this regard, in order to prevent the danger of electric shock by leakage, a business owner should take concrete safety measures such as electric machinery and appliances connected to codes and plugs, the voltage of use exceeds site voltage 150 V, or be connected to the fixed, mobile or portable electric machinery and appliances exposed to shock metal.

Nevertheless, the Defendant did not contact with the Defendant by using a non-sponsor in the compact frame with the site voltage of 220 V, which connects and uses the code and plugs in the vicinity of the above construction site D-4 at the above time.

(c) The business owner shall take measures necessary to prevent the hazards in the places where workers might fall down at work, where sand, structures, etc. might collapse, where material objects might fall or come by flying, and where other hazards may be anticipated in the course of carrying out work due to natural disasters.
