Punishment of the crime

1. The Defendant, as the representative of G Co., Ltd. (hereinafter “G”), invited foreigners wishing to be employed in the Republic of Korea from Vietnam to enter the Republic of Korea for the purpose of export counseling, and conspired with I, H, by lending the name of G to the Republic of Korea.

As above, the Defendant conspired to lend the name of G to H as of November 2013, 2013, and H, around December 2, 2013, made a letter of invitation stating the false details that G’s exporting customer is invited to export counseling and contract the terms of G for export, and submitted G data related to the issuance of the visa to the Vietnamese Embassy for entry through the Incheon Airport on December 21, 2013, in collusion with H, etc., and had three foreigners enter the Republic of Korea by unlawful means, such as the list of crimes (1) of the list of annexed crimes.

2. Defendant B and the Defendants conspired with H by falsely inviting foreigners who wish to be employed in the Republic of Korea from Vietnam to enter the Republic of Korea for the purpose of export counseling upon request of Defendant B, a de facto operator of K Co., Ltd. (hereinafter “K”), to obtain a loan under the name of K and receive a corporate seal impression and certificate of seal impression issued by K and keep the same.

B prepares a false invitation letter, etc. in the name of K to Defendant C on October 4, 2012, and Defendant C sent the false invitation letter to H at that city by international mail, and H shall, around October 10, 2012, invite the exporting customer of K received from Defendant C to export consultation and contract and submit data related to visa issuance to the Embassy of Vietnam, by inviting Vietnam M through the Incheon Airport around October 23, 2012.
