A defendant shall be punished by imprisonment for a term of one year and four months.

Punishment of the crime

1. On March 15, 2013, the Defendant made a false statement to the victim E in the Dong-gu Daejeon District Real Estate Agent Office “D” located in the Daejeon-gu Daejeon District Real Estate Agent Office stating that “In the Republic of Korea, three multi-household housing units are 24 units and 24 units of multi-household housing units in the Chungcheong-gun G with F president and Dong business. The construction cost is insufficient. If one multi-household housing unit is 150 million won, which is 150 million won, and if it is sent KRW 50 million, it is 10 million by completion of multi-household housing units until September 30, 2013.”

However, in fact, the wind to start the above construction of 2.2 billion won without any funds is already required for the above construction at the expense of the above construction, and whether it can continue and complete the construction due to the lack of property owned by others. Therefore, even if the victim borrows additional money from the victim, there was no intention or ability to offer one multi-household house after completing the construction within the agreed period.

Nevertheless, as above, the Defendant, by deceiving the victim as above, received from the victim a delivery of KRW 5 million in total, from the account of community credit cooperatives (I) in the name of the Defendant’s wife under the name of the Defendant’s wife on March 15, 2013, KRW 6 million on March 22, 2013, and KRW 50 million on March 26, 2013.

2. On May 2, 2013, the Defendant made a false statement to the victim by telephone, stating, “The construction work was suspended due to the lack of construction cost at the construction site of the G Multi-household G Multi-household G Multi-household, Chungcheongnam-gun, Chungcheongnam-gun, the Republic of Korea, which was set up in the BF president and the Dong business. If sending KRW 50 million rapidly, the construction work is completed until September 30, 2013, and the first sale is to offer one loan worth KRW 150 million, which is sold first.”

However, as in the above paragraph 1, there was no intention or ability to provide the victim with the above multi-household house.

Nevertheless, the Defendant, as above, deceiving the victim and deceiving him/her from him/her to the account of the above community credit cooperatives under the name of the Defendant’s wife for the purpose of borrowing money from the victim.
