Defendants shall be punished by imprisonment for six months.
However, as to the defendants for one year from the date this judgment became final and conclusive, the defendants are above.
Reasons
Punishment of the crime
1. Defendant A
(a) No person shall register any real right to real estate under the name of the title trustee according to the title trust agreement;
Nevertheless, around April 12, 2012, the Defendant entered into a title trust agreement with the Defendant to complete the registration of ownership transfer with respect to the land located in Suwon District Court, which was actually purchased by the said B, on the following grounds: (a) on April 16, 2012, the Defendant completed the registration of ownership transfer with respect to the said land under the name of the Defendant for sale with the said H, in accordance with the said agreement with the registration of Suwon District Court.
B. Around July 23, 2013, the Defendant drafted a letter of complaint to the effect that “a letter of delegation made by the Defendant J and K in the name of the complainant was forged, thereby making a false letter of delegation made in the name of the complainant, thereby punishing the complainant.”
However, the defendant, around April 17, 2012, signed a letter of delegation directly to K, etc. to delegate his/her authority to prepare a notarial deed, and the power of delegation was not forged, and the above K et al. did not have concluded a loan agreement with the defendant and notarized it.
Nevertheless, around July 23, 2013, the defendant submitted the above complaint to the Suwon District Prosecutors' Office located in the Gonam-dong of the Dong-gu, Ansan-si and brought it to the above J and K.
2. No defendant B shall register any real right to real estate under the name of the title trustee according to the title trust agreement;
Nevertheless, around April 12, 2012, the Defendant entered into a title trust agreement with the above A, a type of land that the Defendant actually purchases, as described in paragraph (a) of Article 1, and entered into a title trust agreement with the Suwon District Court on April 16, 2012, and completed the registration of ownership transfer for the land I located in the above A’s name, as described in paragraph (a).
