1. The Defendants are co-implementers of the Incheon Housing Site Development Project (hereinafter “instant project”), and the Plaintiff is the owner of CY truck (hereinafter “instant truck”).

2. The plaintiff's assertion and judgment as to the plaintiff

A. The plaintiff's summary of the plaintiff's assertion was a construction site located in the project district of this case, and the plaintiff was involved in an accident that the truck of this case was moved to a road due to the landscaped land between the construction site of the Do and the road (hereinafter "the boundary land of this case") in order to load soil and remove the truck of this case, and paid KRW 2,239,00 in order to treat the injury inflicted on the truck of this case, and the expenses of KRW 2,610,00 in the next 2,610 were anticipated to be incurred. The truck of this case was destroyed by the accident of this case and paid KRW 52,32,170 at its repair cost.

In order to prevent the occurrence of an accident, the Defendants shall be obligated to take ordinary protective measures appropriate for the construction site and the entrance section of roads. Article 23 of the Occupational Safety and Health Act (1) of the same Act shall take measures necessary for preventing any of the following hazards in carrying out business:

1. Hazards caused by machinery, apparatus or other equipment;

2. Hazards caused by explosive, inflammable or inflammable substances;

3. Hazards caused by electricity, heat, or other energy. (2) Business owners shall take measures necessary for the prevention of hazards caused by improper work methods, etc. in the course of excavating, quarrying, loading, unloading, timbering, transporting, operating, dismantling, handling heavy objects, and other work.

(3) In cases of places where workers might fall down at work, earth and sand, structures, etc. might collapse, material objects might fall or come by flying, and other places where dangers may occur in the course of work due to natural disasters and acts of God, necessary to prevent such dangers.
