The Plaintiff seeking partial dismissal from September 1, 2020 to pay delayed damages pursuant to the statutory interest rate under the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings. However, the statutory interest rate under Article 3 of the aforementioned Act is applied from the day after the day when the written complaint demanding the performance of monetary obligations or the document corresponding thereto was served on the obligor. Therefore, the part claiming the delayed damages is rejected.

However, from September 1, 2020 to October 8, 2020, the delivery date of the written application for payment order from September 1, 2020, the Plaintiff’s delivery of the leased object of this case to the Defendant shall apply 5% of the statutory interest rate under the Civil Act.
