Defendants shall be punished by imprisonment for one year and six months.

Punishment of the crime

The Defendants are those selected as eligible for subsidies related to “public facility projects” implemented at the early city of the victim around July 16, 2014 by the Defendant.

The Defendants, with respect to the above “public facility project”, conducted a project with the project cost of KRW 1,569,00,000 (the subsidy of KRW 600,000,000) as the project cost of KRW 1,569,00,000. The Defendants conspired to receive the subsidy by submitting a false deposit list in the name of the construction business operator, etc. with the largest amount of money in actual connection with the above project, even though they were able to receive the subsidy to meet the requirements for the fair rate and the self-contributory charges, as they were unable to receive the subsidy due to the lack of the ability to bear the self-contributory charges.

Accordingly, in order to meet the requirements of KRW 283,286,879 of the subsidies in relation to the above business, the Defendants submitted to the public official in charge at the beginning of each deposit sheet, stating the false deposit sheet, as if they were paid KRW 300,000,000 under the name of “the contract deposit for the construction work” and KRW 20,000,000 to E, in order to meet the requirements of KRW 457,515,367 of the subsidies in relation to the above business.

On October 30, 2014, the Defendants were transferred subsidies of KRW 283,286,870 (the victim subsidies of Gangwon-do, KRW 42,493,025, KRW 99,150,410, KRW 141,643,435) from the victim to the Agricultural Cooperative Account in the name of Defendant A (the victim subsidies of KRW 42,493,025, KRW 99,150, KRW 410, and KRW 141,643,435).

As a result, the Defendants conspired to deceive the victim, Gangwon-do, the elementary city of the victim, and the Republic of Korea by deceiving the victim, and at the same time obtain the subsidy of KRW 283,286,870, and at the same time obtain the State subsidy of KRW 141,643,435 by false application, KRW 141,653,435 of the government subsidy of KRW 42,493,025.
