Defendant shall be punished by a fine of KRW 3,000,000.
When the defendant does not pay the above fine, 100,000 won.
Reasons
Punishment of the crime
The Defendant is a deputy head of C (hereinafter referred to as “C”) that conducts plastic bags manufacturing business, etc. in Silung-si, and is in charge of environment-friendly certification.
1. No person other than those who have obtained certification of eco-label, etc. in violation of the Environmental Technology and Environmental Industry Support Act shall place an eco-label, etc. or other similar mark on packages, containers, etc. of materials and products or advertise certification of eco-label, etc.;
Nevertheless, the Defendant, despite the completion date of eco-label certification from October 28, 2015 to October 27, 2017, did not apply for renewal or new eco-label certification. From January 30, 2018 to March 9, 2018, the Defendant indicated the eco-label certification mark on 60 products of “D” which were produced in C.
2. Forgery of private documents;
A. From May 27, 2018 to May 29, 2018, the Defendant copied the original environmental mark certification form issued previously for the purpose of exercising the said C’s office at the third business management department office, and forged one environmental mark certification form in the name of the president of the Korea Environmental Industry and Technology Institute, which is a private document related to the certification, in a knife for the certification period (from October 28, 2015 to October 27, 2017), and in accordance with the certification period (from October 28, 2017 to October 27, 2019) prepared falsely on the copy of a new copy of the certification form.
B. On May 31, 2018, at C’s meeting room, the Defendant copied the original of the environmental mark already issued for the purpose of exercising, with a knife the part of the certification period (from October 28, 2015 to October 27, 2017) into the knife. A new knife copy of the certification period (from October 28, 2017 to October 27, 2019) in accordance with the certification period (from October 28, 2017 to October 27, 2019) in accordance with some numbers (i.e., the “7” in 2017 and “9” in the name of the president of the Korea Environmental Industry and Technology Institute, which is a private document concerning the certification of certification, after attaching it.
