1. 도로 교통법위반( 음주 측정거부) 피고인은 2015. 10. 3. 21:10 경 전 남 함평군 함평읍에 있는 땡 큐 식당 앞 노상에서 같은 읍 중앙 길 199-16 번 길 앞 노상까지 B SM3 차량을 운전하던 중, 신고를 받고 출동한 함평 경찰서 경사 C으로부터 피고인에게 서 술냄새가 나고 얼굴에 홍조를 띠는 등 술에 취한 상태에서 운전하였다고

Since there are reasonable grounds to determine a person, it was demanded to respond to the measurement of drinking in a manner that contains approximately 30 minutes in a drinking measuring instrument.

그럼에도 피고인은 음주 측정기에 입김을 불어 넣는 시늉만 하는 방법으로 이를 회피하여 정당한 사유 없이 경찰공무원의 음주 측정요구에 응하지 아니하였다.

2. 도로 교통법위반( 무면허 운전) 피고인은 2015. 10. 3. 21:10 경 전 남 함평군 함평읍에 있는 땡 큐 식당 앞 노상에서부터 같은 읍 중앙 길 199-16 번 길 앞 노상까지 약 500m를 자동차 운전면허 없이 B SM3 차량을 운전하였다.

1. The former part of Article 37 of the Criminal Act, and Articles 38 (1) 2 and 50 of the same Act, which aggravated concurrent crimes;

1. Article 70(1) and Article 69(2) of the Criminal Act to attract a workhouse;

1. Article 334 (1) of the Criminal Procedure Act concerning the order of provisional payment;
