A defendant shall be punished by imprisonment for not less than three months.
However, the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On November 27, 2015, the Defendant was sentenced to a suspended sentence of one year for larceny, etc. from a member of the Suwon District Court, which became final and conclusive on December 5, 2015.
1. Larceny;
A. On October 29, 2015, around 10:00, the Defendant discovered one mobile phone unit of LG mobile phones in the market price in the CPC No. B located in Seo-gu, Seo-gu, Seo-gu, Seo-gu, Seocheon-gu, 2015, and then stolen the cell phone by driving the cell phone on the table.
B. On March 31, 2015, around 04:30, the Defendant discovered a bank that contains one cellphone 6 and a credit card from the victim E, which was located on the table at the same location as the above A, and stolen the victim by using a crepane.
2. Violation of Acts in financial business specializing in fraud and credit finance;
A. On 31, 2015, around 05:49 on 05:49, the Defendant purchased one of the instant convenience stores operated by the Victim G in Seo-gu, Seocheon-gu, Seocheon-gu, Seocheon-gu, by suggesting that he/she was his/her own purchase and deceiving the victim, and made a credit card sales slips by allowing the victim to pay KRW 1,700, and preparing the credit card sales slips.
Accordingly, the defendant deceivingd the victim, acquired the same amount of property benefits, and used the stolen credit card illegally.
B. On March 31, 2015, at around 06:50, the Defendant calculated the PC room operated by the Victim J, Seo-gu, Seocheon-gu, Seocheon-gu, Seocheon-gu, in calculating the PC usage fee and one bottle of drinking water, and deceiving the victim by presenting the stolen PC card as one’s own act, and thereby inducing the victim to pay 33,000 won to the victim, and drafted the credit card sales slips.
Accordingly, the defendant deceivingd the victim, acquired the same amount of property benefits, and used the stolen credit card illegally.
