피고인은 2018. 7. 21. 00:50경 서울시 강남구 개포동 1197에 있는 수정마을 입구에서 피해자 B(45세)이 채무변제를 요구하였다는 이유로 주먹으로 피해자의 오른쪽 얼굴 부위를 3회 때리고, 발로 가슴 부위를 1회 걷어 찼으며, 계속하여 그곳에 있던 각목으로 피해자의 왼쪽 어깨 부위를 1회 때려 피해자에게 약 2주간의 치료를 요하는 흉벽의 좌상을 가하였다.
