1. The Defendant shall pay to the Plaintiff KRW 44,745,317 and the interest rate of KRW 12% per annum from November 1, 2019 to the date of complete payment.

Comprehensively taking account of the overall purport of the arguments in Gap evidence Nos. 1 through 5, the defendant was continuously hospitalized at C Hospital operated by the plaintiff from July 23, 2018, and the defendant was not paid KRW 44,745,317 to October 15, 2019.

The Defendant is obligated to pay damages for delay at the rate of 12% per annum under the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings from November 1, 2019 to the date of full payment, which is obvious from the date following the day of delivery of a copy of the instant claim and the application for modification of the cause of the claim, which the Plaintiff seeks for treatment costs of KRW 44,745,317 to the Plaintiff.
