A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

[criminal records] On September 28, 2016, the Defendant was sentenced to one year of imprisonment with prison labor for larceny, etc. in the Gwangju District Court’s net support on June 21, 2017, and completed the execution of the above punishment. On September 22, 2017, the Defendant was sentenced to one year of imprisonment with prison labor for interference with business in the Gwangju District Court’s wooden Branch Branch, and completed the execution of the above punishment on July 22, 2018.

[Criminal facts]

1. Even if the Defendant used a taxi, he/she did not have the intent or ability to pay the taxi fee, but did so on July 29, 2018, as if he/she were able to pay the taxi fee on the front side of the wooden Station located south-dong, Hopo-si, Hopo-si, Hopo-si around 04:49 on July 29, 2018, and the Defendant did not pay 3,200 won to the following victim using the said taxi until the road before the Bapo Police Station Interstation, located in 259, Gopo-si, Ypo-si.

In this respect, the Defendant acquired pecuniary benefits by deceiving the victim.

2. Larceny;

A. On August 6, 2018, the Defendant: (a) entered the entrance door in F, operated by the victim E at Sinpo City on August 17:39, 2018; (b) made use of the gap in which surveillance was neglected due to the lack of location; (c) made use of the gap in which the victim’s market price was 10,000,000,000,000 won; and (d) again cut the Defendant’s 10,000,000,000,000 won of the market price into F, and then cut the Defendant’s 10,000,000,000 won of the market price.

B. On August 18, 2018, at around 20:22, the Defendant: (a) committed a theft with one vinyl pool, which contains 750,000 won high compared to the victim’s market price owned by the victim H in Young-gun G, which was operated by the victim H; (b) due to the lack of surveillance in the surrounding areas; and (c) caused the theft by taking advantage of the gaps in which surveillance was neglected.
