Punishment of the crime
[criminal power] On March 24, 2017, Defendant A was sentenced to four months of imprisonment with prison labor for a violation of the Housing Act at the Daegu District Court, which became final and conclusive on April 1, 2017, and on September 7, 2017, Defendant A was sentenced to eight months of imprisonment with prison labor for a violation of the Housing Act at the Daegu District Court and became final and conclusive on November 25, 2017.
【Criminal Facts】
No person shall transfer, acquire or mediate any deed or status eligible for a supply of housing for the purpose of acquiring a supply of housing built and supplied under the Housing Act, or for having others acquire it, and shall acquire or have others acquire a supply of deed, status or housing built and supplied under the Housing Act by fraudulent or other unlawful means.
Nevertheless, the Defendants subscribed to acquire gains from resale by purchasing documents necessary for special supply of apartment units in the name of the disabled with the intention of selling apartment units and the ability of the disabled, and selling apartment units in the name of the disabled.
According to the above public offering, Defendant A notified Defendant B of the information on the application for the sale of the apartment unit D in Busan Metropolitan City on the date of the foregoing public offering, and Defendant B offered that Defendant C, who is qualified for special priority in the sale of the apartment unit, will be granted the special sale of the disabled, if the documents necessary for the application for the sale of the apartment unit are transferred to the Defendant C, and received documents necessary for the application for the sale of the apartment unit from Defendant C, such as a certificate of disability
On October 22, 2014, Defendant A continuously filed a special application for the sale of the above D apartment under the name of Defendant C, and received the winning of the above apartment E, and sold the apartment in an unjust manner.
As above, the Defendants conspired to supply apartment buildings by illegal means.
