1. On May 21, 2013, the Defendant took the same attitude from around 10:00 to around 10:50 on May 28, 2013 to pay the price in E operated by the injured party D, who is in a substantial district of Cheongju-si, and ordered the victim to use a computer located therein, and if the victim’s price is equivalent to KRW 79,600 on the market price, etc.
However, since there was no cash held at the time, there was no intention or ability to pay the price even if the defendant used or was provided with the computer.
As such, the Defendant did not pay the amount of money, even though he had been provided food from the victim by deceiving the victim, and had been provided with computer use services equivalent to KRW 122,100,00, which had been located therein, thereby acquiring pecuniary benefits equivalent to the same amount of money.
Accordingly, the defendant, by deceiving the victim, received property and acquired pecuniary benefits from the victim.
2. On May 28, 2013, from around 12:54 to May 30, 2013, from around 0:25, 2013, the Defendant: (a) by deceiving a victim G on the two-story F2 level working for an employee from HPC room in the manner described in paragraph (1); and (b) provided the victim with food equivalent to KRW 15,000 at the market price by deceiving the victim in the same manner as described in paragraph (1); and (c) by failing to pay the price, the Defendant acquired economic benefits equivalent to the said amount by failing to pay the price.
Accordingly, the defendant, by deceiving the victim, received property and acquired pecuniary benefits from the victim.
3. On June 1, 2013, from around 20:48 to June 16, 2013, the Defendant: (a) provided food and drink equivalent to KRW 4,700 of the market price by deceiving the victims in the manner described in paragraph (1) from K Cccccam room operated by Kcambambi, a considerable amount of Cheongju-si, and (b) obtained economic benefits equivalent to the amount of KRW 15,700, as the market price was not paid, even if the Defendant was provided with computer-use services equivalent to the amount of KRW 15,70,00 in the market price.
