The defendant's appeal is dismissed.

1. In light of the following: (a) the summary of the grounds for appeal recognized the Defendant’s mistake and reflects it; (b) the degree of prosecution is insignificant and there is no record of punishment for the same kind of crime; and (c) the victim expresses his intent that he does not want the Defendant’s punishment, the sentence of the lower court ordering the Defendant to complete a sexual assault treatment program program for 3 months and 40 hours is too unreasonable.

2. The crime of this case was committed on April 8, 2016 after the defendant purchased drinking water from the employee of the PC room, and it was not good that the defendant committed an indecent act on the victim's left chest by force due to his own fault. The crime of this case appears to have occurred due to the crime of this case, and the defendant was sentenced to eight months of imprisonment due to the crime of bodily injury in the support of Suwon Friwon, etc., on October 2, 2015, and was sentenced to eight months of punishment due to the crime of bodily injury, etc., and committed the crime of this case during the repeated crime period after the execution of the punishment was completed, and there was a history that the defendant was not authorized to prosecute because he had expressed his intention that he did not want the punishment, and the defendant's age, sex, sex, environment, degree of damage, motive and circumstance of the crime, etc., and the defendant did not want the punishment of this case after considering all the following circumstances. Thus, the court below's assertion that the defendant did not have been subject to punishment later than 10 years of punishment.

3. The appeal by the defendant is dismissed in accordance with Article 364(4) of the Criminal Procedure Act on the grounds that the appeal by the defendant is without merit. It is so decided as per Disposition.
