The defendant shall be innocent.
Reasons
1. On January 5, 2014, the Defendant: (a) driven a C MT truck on or around 00:35, while driving the said vehicle, the Defendant proceeds in one lane from the intersection without any signal apparatus in front of the E-cafeteria in the Jeon-gu Seoul Metropolitan Area D to the Korean Power from the west B, along with the intersection. Since traffic control is not performed, a person engaged in driving service provided confirmation as to whether there is a vehicle crossing by temporarily reducing or temporarily stopping the speed; and (b) neglected to do so despite the fact that there was a duty of care to yield the way to the right-hand road.
2. Facts of recognition and judgment
A. The following facts can be acknowledged in full view of the evidence adopted by this court and examined by this court.
1) On January 5, 2014, at around 00:35, the Defendant is deemed to be a Mart Freight (hereinafter “cargo”).
2) The intersection without any signal apparatus in front of the E-cafeteria in the Kumjin-gu Seoul Metropolitan City D (hereinafter referred to as the “instant intersection”).
