A defendant shall be punished by imprisonment for one year.
Reasons
A. In fact, the Defendant had no intent or ability to deliver the said car to the victim even if the Defendant received a check from the victim and received the check from another customer, on or around December 8, 2017, when he/she had been discharged from office as a sea-drawer on or around December 8, 2017. As such, the Defendant had no intention or ability to deliver the said car to the victim even if he/she received the vehicle payment from the victim.
As above, the Defendant, by deceiving the victim as above, received from the victim a cashier’s check equivalent to KRW 63,300,000 from the victim for the purchase price of the said car at the seat, and acquired it by fraud.

1. Forgery of private documents related to N or uttering of falsified private documents;
A. A.
