1.The judgment of the first instance shall be modified as follows:

The defendant shall pay 3,284,160 won to the intervenor succeeding to the plaintiff and its corresponding amount.

1. The parties' assertion

A. On September 29, 2011, the Plaintiff operated a member of the instant Council (hereinafter referred to as “the instant Council member”) with the trade name of Plaintiff B, and the Plaintiff supplied Bos and juums (hereinafter referred to as “the instant goods”) mainly used for the instant Council member on a three-month period from the delivery date of the goods, but did not receive full payment of KRW 3,284,160 from the Defendant, so the Defendant is obligated to pay the said unpaid goods and damages for delay.

B. The Defendant did not receive the goods of this case from the Plaintiff, and there is no name and seal of the Defendant or the employee of the instant member on the transaction statement presented by the Plaintiff, and C signed on the biological shipment certificate presented by the Plaintiff is not an employee of the instant member, who is entirely aware of the Defendant. The above transaction statement and the rubber seal affixed on the biological shipment certificate are all forged, and the Defendant did not have concluded a goods supply contract with the Plaintiff. Thus, the Plaintiff’s claim is without merit.

2. Facts of recognition;

A. The Plaintiff is a legal entity that runs wholesale and retail business of pharmaceutical products and medical supplies, and the Defendant is a doctor who registered his/her business in Gangnam-gu Seoul Metropolitan Government D and D from the fourth floor to operate the instant member of the Council and closed his/her business on December of the same year.

나. 원고는 2011. 9. 29.경 이 사건 물품을 보관하던 쥴릭파마 코리아 주식회사(이하 쥴릭파마라고 한다)에게 이 사건 의원에 이 사건 물품을 출하하라는 주문을 하였고, 이에 쥴릭파마는 이 사건 물품을 출하하여 그 배송을 CJ 대한통운 주식회사(이하 CJ 대한통운이라고 한다)에 위탁하였다.
