1. The Defendant shall, in turn, turn out to the Plaintiff each point indicated in the attached Form 1, 2, 3, 4, and 1 on the ground of 1,612 square meters in Hongsung-gun, Chungcheongnam-gun.
Reasons
1. Determination on the cause of the claim
A. 1) On December 31, 1963, the Plaintiff: (a) on December 31, 1963, the Plaintiff (hereinafter “instant land”).
(2) Around July 2000, the Plaintiff entered into a lease agreement with the Defendant to lease the instant land (the land category at the time was “former”) to the Defendant for three years on a rent of KRW 1,00,000 per annum. On November 21, 2000, the Defendant changed the land category of the instant land into the site, and on December 11, 2000, newly constructed a light steel-frame prefabricated type, prefabricated type, cellllll, roof, neighborhood living facilities, 168.10 square meters on the instant land, and then run a business of selling salted fish, and newly constructed a f9.6 square meter on the instant land on September 20, 201.
3) On August 20, 2010, the Plaintiff agreed to lease the instant land between the Defendant and the Defendant for three years as the use of each of the above buildings, with the annual rent of KRW 1,500,000. Upon the expiration of the contract, the Defendant shall immediately restore the instant land to its original state upon the expiration of the contract (Article 7; hereinafter “instant restitution clause”).
3) A lease agreement (hereinafter “instant lease agreement”)
(4) Around the closing date of the argument in this case, the part of “A” connecting each point on the instant land in order to each point of indicated 1, 2, 3, 4, and 1 of the annexed drawings, and 45m2 of the same drawings, each point of which is indicated 2, 5 through 14, 3, and 2 of the same drawings, shall be connected to “B” part of “B,” which connects each point of “B,” in the order of 216m2, 25 through 18, and 15 of the same drawings, and 15m2, 7m2, 19 through 22, and 19 of the same drawings, and 47m2, 47m2, 37m2, 37m2, 37m2, and 19 of the same drawings, which are connected to each point of “B,” in the order of each point of “B” part of the same map.
