A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Forgery of private documents;
A. On July 26, 201, the Defendant forged private documents under the name of D and E: (a) entered the name of D and F in a place where it is impossible to know on July 26, 201; (b) entered that there was no delegation from D and F with respect to the acquisition and transfer of stocks; (c) entered into a stock and water supply contract; (d) D; and (e) enter into this contract by using a computer to transfer the stocks of D and E; and (d) entered into this contract to B as follows; (d) “the number of stocks transferred: 20,000 shares;” “the number of stocks transferred; 20,00 shares”; (d) July 26, 201; (e) entered the name of D and D; and (e) put a prior seal attached to and kept in custody of D; and (e) put a prior seal attached to E’s name.
Accordingly, for the purpose of exercising authority, the Defendant forged one copy of the share and water supply contract in the name of D and E, a private document on rights and obligations.
B. The Defendant forged private documents under the name of E and H at a place where it is impossible to know on June 7, 2013, without being delegated by E and H with the authority to take over and transfer shares, the Defendant: “stock and water supply contract”; “E”; “resident number: “I”; “resident number: “B”; “B”; “B”; “I”; “I will transfer the shares of “B”; and enter into this contract as follows; “the number of shares transferred: 20,000 shares; “The number of shares transferred: 5,000 shares; “10,000,000 won per share”; “the class and quantity of shares issued”; “the type and quantity of shares issued: June 7, 2013; and “the name and quantity of the transferee”; “H”; and “the name and quantity of the transferee (H)”; and “the name and quantity of the transferee(s) before being kept under his/her prior custody.”
Accordingly, for the purpose of exercising authority, the Defendant’s shares and water supply contract without authority, which is a private document related to rights and obligations, are in the name of E and H.
