A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Criminal facts
The Defendant served in Asan City Co., Ltd. from August 2010 to June 2012.
1. Fraud against victim D Co., Ltd.;
A. On March 13, 2012, the Defendant made a false statement to the effect that “F shall pay the price of meat at KRW 10 million to E, a representative of the victim,” at the victim’s office.
However, even if the victim received KRW 10 million from the victim, there was no idea that the plaintiff would pay the price of the fry to F, which was the business partner, and it was thought that the defendant would pay the price of the fyer's fyer's fyer's fyer's fyer
As such, the Defendant, by deceiving E, obtained money of KRW 10 million from the same day from E to the national bank account (H) in the name of G designated by the Defendant.
B. On June 17, 2012, the Defendant made a false statement to the effect that “The Defendant sent money to E to pay the delivery price to E” at the victim’s office.
However, even if the victim received money from the victim, the victim did not think that it would be paid to I as the delivery price, and was used for personal purposes.
As such, the Defendant, by deceiving E, acquired KRW 2,241,00 from the Defendant’s mother to the Agricultural Cooperative (K) account under the J on the same day.
2. The same year from April 27, 2012, the accused against the fraud of the victim (the victim).

Until December 15, 198, the fact was committed as if it had been ordered in D without the intent or ability to pay the price, and the fact ordered the livestock products to the employee under the name of the victim (the state) who was the customer of D Co., Ltd. who was the customer of D, and then, the livestock products in the amount of KRW 6,764,234 of the market price were supplied by the victim and acquired them by deception.
