1. Basic facts

A. The Plaintiff’s subsidization 1) B Co., Ltd. (hereinafter “B”).

(2) On November 13, 2008, Jeonnam-do and the Plaintiff entered into an investment agreement with the effect that B, from November 2008, to December 201, 2012, in the form of an enterprise, a corporation, or an incorporated farming association in the form of J, extraction, and production of agro-fishery materials, and invested KRW 6.2 billion in a project to create a large-scale KK complex. 2) On January 2009, Jeonnam-do Do governor decided to designate a specialized item of the region and grant subsidies to a specialized product promotion project with respect to the “specialized product promotion project for 2009” in relation to the designation of the specialized item of the region and to support the project to increase farmers’ income by developing the regional brand.

The main parts related to this case among the details of the above specialized product promotion project and the decision to grant subsidies are as shown in attached Form 2.

3) On March 5, 2009, the Plaintiff selected B as one of the above specialized product promotion projects, “C development projects (hereinafter “C development projects”) subject to the project, and decided to grant subsidies of KRW 600,000,000,000,000,000,000,000 for the construction of a factory of one unit in this Chapter as subsidies. 4) B notified the Plaintiff that it is eligible for the project of this case, and on March 11, 2009, the Plaintiff applied for subsidies in the name of the Korea Agricultural Company D Co., Ltd. (hereinafter “D”), a local subsidiary established by B for the smooth implementation of the instant subsidized project.
