A defendant shall be punished by imprisonment for a maximum term of one year and six months, and a short term of one year.

Seized evidence as referred to in subparagraphs 1 through 6, and 10 shall be confiscated.

Reasons

Punishment of the crime

1. Habitual theft;

A. B, around June 26, 2019, the Defendant: (a) confirmed that the victim D’s B character car parked at the Annsan-gu Seoul apartment parking lot at the front week was not locked; (b) opened a door of the said car; and (c) cut off the vehicle with one of the two keys in the EMW car.

B. Around 02:08 on June 27, 2019, the Defendant: (a) confirmed that the FMW car of the victim H, parked in the G Apartment-gu G Apartment-gu G Apartment-gu Seoul Special Metropolitan City, was not fastened; (b) opened a chief door of the said car; and (c) cut off the car with one cash amount of KRW 80,000 and one NAS-gu smart key in the wall located in the container box at that place.

C. At around 02:13 on the same day as Paragraph 2(b) of Article 2, the Defendant: (a) discovered the victim JJ’s IB car at the same place; (b) opened a copy of the said car; and (c) opened a copy of the said passenger car; and (b) committed a theft with the sum of KRW 42 million in total of KRW 2,000,000,000,000,000,000,000, in the back of the check; and (b) opened a copy of the said passenger car; and (c) opened a copy of the said passenger car; and (d) one K Check at the back of the documents.

Accordingly, the defendant habitually stolen another's property three times.

At around 22:59 on the same day as paragraph 1(a), the Defendant: (a) opened an EMW car door at the same place; (b) used the key to the DMW car of the victim who stolen, as set forth in paragraph 1(a); and (c) displayed the object to be stolen; (c) did not constitute a theft object; and (d) did not constitute an attempted object.

Accordingly, the defendant habitually attempted to steal another's property and attempted to do so.
