Reasons
Punishment of the crime
Amendment ex officio to the extent that the identity of the facts charged is recognized.
1. Fraud against the victim C;
A. On August 2009, the Defendant told the victim C (the age of 29) to hold a public performance in the Republic of Korea “D” as the musical community around May 2010. The musical performance right was already obtained, and the rent, marketing, and other operating expenses are required. If the Defendant invested KRW 80 million, he would provide E with 40% of the corporation’s equity interest and pay 20% of the D domestic performance revenue.
However, the Defendant was unable to obtain the right to perform “D”, and there was no intention or ability to pay the proceeds promised to receive the investment money from the victim.
