The defendant shall be innocent.

1. Facts charged;

A. The Defendant, taking advantage of the position of the vice-chairperson of the C Apartment Council, made several intimidations to the effect that “the head of the management office of the said apartment (57 years of age) would replace the head of the management office in case where the said apartment management office does not properly comply with the horses,” and had the victim of the said apartment in mind to take property from the food victim.

1) The Defendant, at the above apartment management office located in Ulsan-gu, Ulsan-gu, Seoul-gu, the end of March 2010, told the victim to the effect that “the head of the Dong shall engage in the activities of the vice-chairperson, use money, and request money.” As above, the Defendant was transferred KRW 1 million from the victim who was drinking by the Defendant’s intimidation on April 2, 2010, at around 15:42, 2010. Accordingly, on October 12, 2010, the Defendant was provided property by the Defendant. 2) The Defendant received money from the victim at the same place as the above paragraph (a) of the above, “on the part of the head of the local council of occupants’ representatives, there is a lack of activity expenses for the Defendant to act as vice-chairperson of the council of occupants’ representatives.”

The Defendant received 300,000 won from the frightened victim of the Defendant’s intimidation as above. As such, the Defendant frightened and received property from the Defendant. B.
