프로그래머 D는 땡 큐( 히어로), 337( 몬스터), 올림픽 등 성인 도박사이트, 한 게임, 피망 등의 사이트 등에서 상대방의 패를 훔쳐보며 도박을 할 수 있는 프로그램 ‘E’( 이하 ‘ 뷰어 프로그램’ 이라 한다 )를 개발하여 이를 전국의 PC 방에 설치하는 역할, 피고인 A, 피고인 B은 위 뷰어 프로그램을 배포할 수 있는 권한을 가지고 이를 판매 책( 소위 ‘ 롤링 맨’ )에게 제공하는 총판의 역할, F, G, H 등은 위 피고인들 로부터 위 뷰어 프로그램을 전달 받아 전국 각 지역의 매장 운영자들( 위 뷰어 프로그램을 이용하여 도박하여 수익을 얻는 사람 )에게 위 뷰어 프로그램을 판매 설치하여 주면서 일일 사용료를 받는 판매 책의 역할을 하기로 순차 공모하였다.
