1. The part of the judgment of the first instance against the defendant is revoked, and the plaintiffs corresponding to the above revoked part are against the defendant.
Reasons
1. Basic facts
A. 1) The Plaintiffs are co-Defendant H Co-Defendant 1, Ltd. (hereinafter “H”) in the KOSDAQ market between around 2007 and around June 2013.
2) On January 3, 2001, H was listed on the KOSDAQ market operated by the Korea Exchange Co., Ltd. (hereinafter “Korea Exchange”) (hereinafter “Korea Exchange”), which was delisting on September 10, 201.
3) Defendant and the first instance court co-defendant I, K, and P work for H as the representative director, director, and auditor, and the specific tenure of office is as listed in the following table. The term of office is from March 23, 2007 to June 4, 2013 (director) to June 26, 2010 to June 4, 2013 (representative representative director) the co-defendant I and the representative director of the first instance court are co-defendant I and the jointly-defendant I were co-defendant I and the representative director of the second instance court on March 30 to November 25, 2013 (domestic Director), and the audit report of Defendant 2 and the outside director of the second instance court on March 23, 2013 to November 25, 2013 (hereinafter “Defendant 2 and the outside director of the second instance court on March 23, 2013”) are as follows:
