1. The Defendant shall pay to the Plaintiff KRW 33,51,00 and interest rate of KRW 15% per annum from June 17, 2017 to the day of complete payment.
Reasons
1. From September 15, 2015 to August 26, 2016, the Plaintiff supplied ready-mixeds equivalent to KRW 156,868,00 to the construction site for which the Defendant proceeds. However, the Defendant did not pay KRW 123,317,00 for goods already paid after September 13, 2016.
Therefore, the Defendant is obligated to pay to the Plaintiff damages for delay calculated at the rate of 15% per annum from June 17, 2017 to the day of full payment, which is the day following the day when the original copy of the instant payment order was served on the Plaintiff.
