Basic Facts

The plaintiff is a person who purchased the first floor F of the 6th E Commercial Building (hereinafter referred to as the "instant building") on the ground located in G in G for the purpose of leasing to a pharmacy, and the defendant is a person who provides consulting services on attracting hospitals, etc., and G is a pharmacist who leases the above store by introducing the defendant.

On October 2015, the Plaintiff requested the Defendant to provide consultation to lease the instant store as a pharmacy. On October 24, 2016, the Defendant entered into a contract with G to the effect that “the Defendant transfers the right to lease the instant store to G with the total premium of KRW 150 million” (hereinafter “instant transfer contract”).

(A) The transfer contract of this case contains the following special terms and conditions:

1.The hospital of this building shall be subject to the starting of the infant juvenile department, internal department, non-humane department, obstetrician and 5 imposed person.

2. In the event that the lease contract is not smooth, this contract shall be null and void;

3. Terms and conditions of the lease agreement shall be KRW 150 million, monthly rent of KRW 500,000 (excluding value-added tax).

4. A pharmacy shall be a pharmacy of a building;

5. This premium shall be paid for support costs for the interior of the hospital in tentatively named (H Council Members).

6.A letter of confirmation to the President shall be issued to the President, and all liabilities thereafter shall exceed the President.

On October 25, 2016, the Plaintiff entered into a lease agreement (hereinafter “instant lease agreement”) with G introduced by the Defendant and the instant store with KRW 150 million, monthly rent of KRW 50 million, and KRW 5 million with respect to the instant store.
