The prosecutor's appeal is dismissed.

1. 항소이유의 요지(사실오인 및 법리오해) 피고인이 피해자의 팔과 얼굴 부분을 손가락으로 튕기고 피해자의 뒷머리를 쓰다듬은 행위는 피해자의 성적 자기 결정권을 침해하는 행위이므로 강제추행죄가 성립한다.

2. Summary of the facts charged in this case and the judgment of the court below

가. 이 사건 공소사실의 요지 피고인은 2018. 05. 06. 02:10경부터 02:40경까지 서울 강남구 B건물 지하1층에 있는 ‘C' 주점에서 피해자 D(여, 32세)의 왼팔 맨살 부분을 갑자기 손가락으로 튕기듯이 만지고, 피해자가 이에 항의하면서 “내 몸에 손대지 마라.”고 거부하는데도 불구하고 계속하여 피해자의 팔과 얼굴을 손가락으로 튕기듯이 만지다가 피해자가 거세게 항의하면서 “진짜 하지마.”라고 말하자 “어이구, 알았어, 알았어.”라면서 오른손으로 피해자의 뒷머리를 쓰다듬어 만졌다.

Accordingly, the Defendant committed an indecent act on the part of the victim.

나. 원심의 판단 원심은 피고인이 고소인 D의 왼팔, 얼굴 등을 손가락으로 튕기듯이 만지고 뒷머리를 쓰다듬은 행위는 인정하면서도 그 행위가 고소인의 성적 자유를 침해하는 추행에 해당한다고 단정하기 어렵고 피고인에게 추행의 고의가 있다고 보기도 어렵다는 이유로 피고인에 대하여 무죄를 선고하였다.

3. The judgment of this Court

A. The crime of indecent act by compulsion includes not only the case of indecent act committed after making it difficult to resist by means of assault or intimidation against the other party, but also the case of assault itself as an indecent act. In this case, as long as the assault does not necessarily require that it be enough to suppress the other party’s intent, and there is the exercise of tangible force against the other party’s will, regardless of its force’s exaggeration, the indecent act is objectively sexual humiliation to the general public.
