1. The plaintiff's appeal is dismissed.

2. The costs of appeal shall be borne by the Plaintiff.

The purport of the claim and appeal is the purport of the appeal.

1. Basic facts

A. The Plaintiff is the Ministry of Foreign Affairs of Defendant B, and Defendant C is the wife of Defendant B, and Defendant D is the children of Defendant B and C.

B. In around 2005, Defendant B entered into an agreement with relatives, including the Plaintiff, that purchased 3,147 square meters prior to Ulsan-gu E, Ulsan-gu (hereinafter “land prior to subdivision”) prior to the sale of the said land by receiving investment funds from the Plaintiff, and then, sold the said land again, and then made an agreement with investors at the ratio of investment to settle the proceeds from the sale of the said land (hereinafter “instant investment agreement”).

C. According to the instant investment agreement, the Plaintiff invested KRW 350 million in total in Defendant B, including KRW 200 million loaned by Defendant B and KRW 150 million directly raised by the Plaintiff.

On June 17, 2005, Defendant B entered into a sales contract with 1.15 billion won of the purchase price of the land before subdivision from the Subdivision under Defendant D’s name. On July 26, 2005, as to the above land, the registration of transfer of each share of KRW 100/952 in the name of the Plaintiff, K, 100/952 shares in the name of the Plaintiff, K, 200/952 shares in the L, 252/952 shares in the M, 252/952 shares in the M, 10/952 shares in the future of Defendant D.

E. Thereafter, the land before subdivision was divided as listed below:

On July 26, 2005 (Acquisition) on April 20, 207, 2007, the same land before the division (division and merger) on November 23, 2010 (division and merger) on November 23, 2010, 2010, Dong-dong (hereinafter “division”) 2,155 square meters prior to E - the 991 square meters prior to G 456 square meters prior to 667 square meters prior to G, 456 square meters prior to 456 square meters prior to G, 496 square meters prior to 211 square meters prior to G, 211 square meters prior to 456 square meters, - 92 square meters prior to F. 92 square meters - 992 square meters prior to G.

F. As above, Defendant B sold the partitioned land at a total of KRW 1.795 billion from September 2007 to April 201, 201, and received full payment of the purchase price.

The purchase price of land for which H. 496 square meters was 496 square meters on September 6, 2007, KRW 1,795,500,000 on October 19, 2010, KRW 991 square meters on September 19, 2010, KRW 991 square meters on September 6, 2007, KRW 1,795,500,000 on November 76, 2010, KRW 211 square meters on December 76, 2010, KRW 456 square meters on April 29, 201, KRW 1,795,500,000 on April 29, 201.
